The nature of the contract

Our ’Contract between Content Creators and Followers’ ​​document sets out the policies and rules that ensure and regulate collaboration and transactions between a content creator and a follower.

Application and due date

The Contract (also known as the Agreement) is entered into and applies when followers (also known as subscribers or fans) subscribe to one or more of the to multiple content creator profiles and initiate a transaction toward Dizzyfans.com content creators.

Contracting parties

Two parties are involved in this transaction. One is the follower who initiates the transaction, the other is the content creator who provides content for which he receives financial share. The contract between the two parties will take effect upon subscription and transaction. With the platform (website), Dizzyfans.com acts as an intermediary in the execution of transactions. The transaction on Dizzyfans.com is performed with the involvement of an external payment service provider.

Fees

By initiating the transaction, the subscriber undertakes to pay the content creator pre-determined fees, which are found on Dizzyfans.com. Furthermore, the parties agree that, subject to the laws of the party initiating the transaction, the fees may be subject to Value Added Tax (VAT) and authorize Dizzyfans.com to act as an intermediary for the payment transaction. VAT rate may depend on the country. Dizzyfans will act as an intermediary in this transaction and the parties agree that Dizzyfans will manage these revenues. Dizzyfans retains VAT for the amount received and forwards it 100% to the competent tax authorities and collects from the net amount (not subject to VAT) the processing fee specified in the general terms and conditions and conditions of use.

Dizzyfans.com will retain the amount received after deducting any VAT, referral fee and processing fee and will retain it in its possession until the content creator pays. The reference fee is deducted from the collection fee, i.e., the Dizzyfans fee, so this fee is not borne by the content creator.

Payment

Within a few business days, Dizzyfans.com will transfer the amount to the account number provided by the content creator. The content creator assumes full responsibility for the account number.

Payment can be automatic or manual, in each case determined by the content creator.

Copyright

Between the conclusion of the agreement and the transaction between the follower and the content creator, the “buyer”, i.e., the follower, acknowledges that the copyright and all other rights are still the property of the content creator. The buyer, i.e., the follower, has no rights over the content. Purchased content may not be copied, transferred, saved, or distributed in any way. Piracy and copyright are governed by strict laws, the violation of which is a criminal offense and has consequences. The follower has the right to view through a browser up to a monthly or occasional subscription to that content. It is forbidden to copy, distribute or own it and it is expressly prohibited, and constitutes an illegal act.

Access to the content, i.e., the right to view, is not reached in the following cases:

  • Failure to pay
  • Payment cancellation, refund
  • In case of pay per view if the follower has finished viewing the content
  • In case of expiration or non-renewal of the subscription fee / subscription (if the subscription is not automatic)
  • If the content creator suspends or terminates his / her account
  • If the content is removed from the content creator’s account
  • If the content creator bans / restricts the follower from the account
  • If Dizzyfans restricts the content creator’s account due to policy violation

Cooperation of the parties

  • The follower claims the content of the content creator (image, video, audio or any other type of content or any product) when initiating the transaction. Once the transaction has completed, in case of a successful payment, the content creator is obliged to provide the buyer, i.e., the follower, with a viewing right and opportunity to access the relevant content.
  • The content creator undertakes that the content in question does not violate our General Terms and Conditions and does not contain any scenes suggesting a crime. Otherwise, he / she accepts the consequences of criminal liability.
  • The follower agrees and declares that he / she will complete the transaction to access / view the content in question and will not initiate a refund unless he / she has been the victim of a scam.
  • The content creator, under penalty of perjury, declares and warrants that the content uploaded to Dizzyfans.com is his / her own property and does not infringe copyright. The content creator consents to his / her followers gaining viewing / access rights based on any fees he / she may set.
  • The content creator (image, video, audio, etc.) is solely responsible for the content published by the content creator.
  • The follower declares that he / she has access to the content of the content creator at his / her own risk.

Refund

Dizzyfans.com and its policy entitle the follower and give him the right to file a complaint if he / she has been the victim of a scam and the transaction has completed but has not received the content. 

In accordance with the law, we will investigate the case and take moderating and legal action if necessary.

Content management

The parties acknowledge that the content creator may remove and add content to their account any time, which they may post at their sole discretion. Accordingly, the content creator decides whether contents are free, subscription-based, or provides a one-month subscription to access general content, and additional content is paid for. Therefore, both parties acknowledge and agree that there may be content that is not accessible to the follower / subscriber.

Complaints

The parties agree to seek a compromise solution in the event of a dispute and shall use their best endeavours to resolve the dispute amicably. In case of a different place of residence, the follower may also rely on laws of his or her own place of residence.

The complaint must be settled between the two parties, but Dizzyfans must always be aware of the case. Therefore, do not forget to send the case to the email address support@dizzyfans.com.

In case of legal proceedings, parties may bring an action in the court of the place of residence of both parties.
