This document serves as an agreement between the users of Dizzyfans.com and the company that operates Dizzyfans.com. Please read it carefully and re-read from time to time, as we may make changes to this agreement. We will endeavour to notify you of significant changes, but you had better re-read this agreement from time to time. In urgent cases and emergencies, we may change the terms of our service without notice.

If you do not agree with our terms, you may terminate your cooperation with Dizzyfans.com and terminate your account anytime.

Tax = Taxes of any kind that does not belong to Dizzyfans.com but to the authorities of the place of residence of the follower.
VAT = Value Added Tax, which may vary from country to country.

What is Dizzyfans.com?

Subscription-based social site designed to connect fans with their idols.

Registration

To use Dizzyfans.com, all the users must register, regardless of whether you want to be a fan or a content creator. Registration is recommended and allowed for people over 18/21 with an independent power of decision. Please give your name, a valid email address, and a password that is as secure as possible.

When registering, always follow the laws of your residence and register only if they allow and permit such a presence. Generally, if you are over 18/21, you can register without any interruption, but we recommend that you should check laws in your residence.

If you intend to register as an additional content creator, we will request additional personal data, as well as IDs, documents, and self-made images, necessary for identification, in order to verify the authenticity of your person. We store this data strictly in accordance with the applicable data protection regulations.

By registering, you are responsible that:

All the data and information are correct.
You will update your data immediately in case of any change.
You agree to the terms of service and the handling of your data and compliance with the rules.
You consent to us verifying the accuracy of your information and communicating with you via email, message, telephone or in any form on Dizzyfans.com.
You let us know via support@dizzyfans.com if you notice anything unusual in your account.
You manage your Dizzyfans account safely and carefully. You always log out of your account when you leave and strictly guard your login.
You are responsible for all the activities in your account.
Under penalty of perjury, you declare that you will not commit a crime on Dizzyfans.com.
You agree that your account may be suspended immediately, even without notice, if you violate the rules or we detect a crime in your account.

Dizzyfans.com is not responsible for the content posted on the site, however, our team constantly scans the content of the website and may, if necessary, moderate it without your permission, in which case the account may be restricted, suspended, or terminated. If the decision is disputed, you can request review via support@dizzyfans.com. We will notify you of the review and the final decision. If you are right, you will get access back, if you violated the rule, we will permanently suspend your account.

Dizzyfans.com does not intend to promote unethical things. Our goal is to create a closer connection between users. However, we are not responsible for the content, or the service provided by the content creator. Both the follower and the content creator act at their own risk.

We are committed to protecting children on our website.

In case of technical problems, users give the employees at Dizzyfans.com permission to manage their accounts if necessary. All the legal steps regarding account management by our moderator are accepted by the user.

The agreement and ’cooperation’ may be terminated both by Dizzyfans.com and users.

Dizzyfans.com reserves the right to remove content or suspend accounts immediately, terminate accounts and take appropriate legal action in the event of a crime. After suspension, your account content and data will continue to be stored in accordance with data protection laws.

We have the right to review the accuracy of your content and information. In the event of abuse or crime, we may take legal action and cooperate with various authorities. This allows law enforcement agencies / authorities to provide information about the suspicious account in the event of a suspected crime.

We may transfer certain data to third parties, e.g., payment service provider. We will notify you in case of any change in the third party.

All user-generated content on Dizzyfans.com is the property of Dizzyfans.com.

We are not responsible:

We make every effort to keep Dizzyfans.com safe, however, we cannot take responsibility for some things.

Our moderators review the content, but we cannot monitor each content in real time.
We do not grant any rights to the followers over the content
You cannot exercise a claim about who sees / has seen your content. You can filter it manually and block those from your profile who you don’t want to see among your fans.
We are not responsible for the content and the services used and their authenticity. We are not obligated to respond, monitor, and criticize every single content / service.
We cannot take responsibility over you. You declare that you use the site at your own risk.
We do not promise or guarantee revenue.
We are not responsible for the accuracy of the content, or the effectiveness of the services offered by the content creator.
For errors not attributable to Dizzyfans.com.
For viruses sent on Dizzyfans.com. We try to intervene immediately, but it is possible that by then the virus will reach people.
We take no responsibility and cannot control if users save, use, or transmit, reproduce, or upload content posted by the content creator elsewhere. We are strictly opposed to this, but we cannot prevent it.
Deleting your account does not eliminate the problem with content that has been ’stolen’.

Under penalty of perjury, you declare that:

The content and data published on Dizzyfans.com are your own property, they are real, and you have maximum control over them, or you have an official authorization from the owner to legally use such content for such purposes.
You grant us the right that our team (moderators) moderate your content as necessary or take any action that may be restrictive.
You grant the right to remove your content from infringing account in the event of unauthorized reproduction or disclosure.
After deleting your account, your username is available for others to use. Afterwards, you cannot exercise any claims.
com does not pay or claim any license fees from you.
You declare that you waive all rights and do not object to the operation of Dizzyfans.com.
You allow us to add watermarks, stickers, links to your images.

You may use the URL / link of Dizzyfans.com or your profile anywhere, but only for positive reasons, to promote your own profile or site.

Please read the terms of use and legal documents of the given platform for such promotion. During such promotions, do not personate anyone from Dizzyfans.com.

External links on Dizzyfans.com are strictly controlled in each case, however, we recommend that you should browse these links and websites at your own risk. We accept no liability for any damage.

Deleting an account

You can delete your account at any time. All you have to do is enter the settings.

If you are a follower, your account will be deleted shortly.
If you are a content creator, your account will remain valid until the last paid day of your subscribers.

If you delete an account, we will not charge any additional fees or earnings and the entire contents of the account will be deleted and cannot be restored.

Responsibility for damage

We will do our best to ensure that no user is harmed. However, we cannot guarantee it. We take all the responsibilities that fall under our competence and are permitted or required by law. We take responsibility for serious mistakes of our employees, such as death or serious personal injury, and we strive to ensure safety of our users. If we are aware of any crime, harm, or fraudulent activity, we will take immediate action. We filter and moderate misleading content and accounts in the same way.

However, we will not be liable for any loss of revenue or profit of any kind, scam, fraud and any activity that is beyond our control and cannot be controlled or expected to be manually controlled.

By accepting the legal terms for registration, users declare that they behave ethically and non-criminally on the site under penalty of perjury. After registration, the responsibility lies entirely with the users.

Dizzyfans.com cannot monitor the content of accounts and posts continuously, however, our moderators do everything they can to identify and moderate inappropriate content and accounts. Therefore, Dizzyfans.com is not responsible for the content and accounts. It is the user who is responsible.

We will not be responsible for any unforeseen direct or indirect loss, damage, property damage, technological damage, virus attack, crime, fraud, misrepresentation, reputational damage, loss of data or content that is inconvenient or harmful to one or more users, but we will take appropriate action and we will be involved in law enforcement support if necessary. Use Dizzyfans.com at your own risk. We take no responsibility for anyone who violates the terms of use.

We cannot be held responsible if a follower copies, reproduces or distributes your private content, thereby infringing your copyright. This discussion needs to be settled directly by the two parties (the follower and the content creator).

We cannot be held responsible if a user discloses your content, data, or identity.

By registering, you accept the following:

You agree to the terms of use and the policy of the site.
You follow each point to the best of your ability.
We reserve all rights to the efficient, safe and effective operation of Dizzyfans.com.
All the users use the site at their own risk.
Users do not acquire any rights over Dizzyfans.com.
The contract and account concluded with us may not be transferred without our consent
Our current policies are set forth in the Terms of Service, contract, copyright, DMCA, USC and other legal documents.

Conditions for disputes

In case of any interruptions, concerns, problems with Dizzyfans.com, contact us via support@dizzyfans.com and we will try to respond and resolve it as soon as possible.

Terms and conditions for followers / fans / subscribers

This part of our Terms of Service is about the agreement between Dizzyfans.com and your followers. All the users who are not official, content-registered content creators, only followers / subscribers / fans, are therefore registered to view our content to view the content.

At the time of registration, all of our users warrant (assume legal responsibility for) that they are over 18/21, i.e., adults.
If you are not considered an adult in your country of residence from the age of 18/21, you declare that you are an adult under the applicable rules.
You represent that the laws of your country of residence and applicable to you do not prohibit the use of Dizzyfans.com.
You warrant that each content you post on Dizzyfans.com and your behaviour will comply with our Terms of Use / General Terms and Conditions.
You warrant that each content you post on Dizzyfans.com is your property and that you are the copyright owner or authorized to use that content.
You agree to use Dizzyfans.com at your own risk and to indemnify users and, if necessary, Dizzyfans.com for any damages.
You agree that we are unable to monitor every single content and that we expect you to behave ethically.
You acknowledge that Dizzyfans.com, although it is not an adult website, may contain content that is for those over the age of 18/21. We will not be responsible if you find such content or if any damage arises from uploading or viewing such content.

Rules for transactions

A transaction can occur between the content creator and the follower. Dizzyfans.com makes it possible on its website via an external payment service. Dizzyfans.com is not a party in the transaction, it only acts as an intermediary, therefore it does not take responsibility for the authenticity of the transactions.

The rules of the transaction are contained in this document and the Agreement between our content creator and the follower.

A content creator may charge fees for tracking their accounts and other private content and services. The price is set in advance by the content creator, which is clearly visible on the Dizzyfans.com interfaces. The price is displayed in USD.

The price shown does not include taxes such as VAT which our system automatically adds to the amount in a clear way during the transaction. VAT may vary by country.

To complete the transaction, you will need to add a credit card to your account.

As we use an external payment service provider, you declare that you provide the right to transfer the details of transaction to the payment service provider and debit your credit card for the transaction you have specified in order to complete the successful transaction.

We are not willing to regulate or criticize the payment service provider and banks, therefore the execution of all transactions falls under the payment service provider’s own competence. You will need to discuss any currency conversions or other bank charges with your bank.

Monthly subscriptions are subject to a monthly transaction, while occasional payments are made at that moment. The amount is transferred by the payment service provider to Dizzyfans’ account. The tax value will be retained and further transfer to the competent authorities, the management fee for Dizzyfans.com will be deducted and the amount will be credited to your content creator’s account.

All transactions are completed at the user’s own risk. Dizzyfans.com is not responsible for any transactions.

If a free account becomes paid or the content creator decides to increase the price, we will notify you, but the fee will be automatically deducted.

Under penalty of perjury, you declare that you will not claim an unreasonable refund. You will claim refund if you have been the victim of a fraud or crime. Dizzyfans.com is not responsible for such events and does not guarantee a refund. However, it plays an assisting and supportive role in the fair conclusion of such cases. We cooperate with users and possibly law enforcement agencies and authorities, governments. Fraudsters are immediately banned from our site, as are users who request a deceptive refund.

If the accounts are suspended, the user will be immediately banned, therefore any transactions will be delayed or cancelled. The account will be fully blocked.

Terms and Conditions for Content Creators

This section of our Terms of Service document deals with the agreement between Dizzyfans.com and the content creators. All the users who are registered content creators / content providers for profit are required to acknowledge.

Core rules:

At the time of registration, all of our users guarantee (assume legal responsibility for) that they are over the age of 18/21, i.e., an adult, or an adult in their country of residence.
You declare that you share real content and data with Dizzyfans.com and your followers.
You declare that you represent ethical behaviour and conduct on Dizzyfans.com and do not use the Site for criminal purposes.
You declare that you share all necessary personal and other information with us and cooperate with the Dizzyfans.com team.

How much does it cost to use Dizzyfans.com as a content creator?

The use of Dizzyfans.com is free. Content creators need to pay when they request payment of their revenue. The fee to Dizzyfans.com is 20% of the pending amount. The outstanding 80% is owned by the content creator. (The bank of the Content Creator may charge additional fees for transactions.) The fee includes the service, maintenance, and operation of Dizzyfans.com.

How to register as a content creator?

First, register as a user on the main page of www.dizzyfans.com. Then click on the “become a content creator” button on the left side.

Enter your personal information correctly and upload photos of an ID document or upload an image showing your face and holding your ID in your hand.

Take and submit a photo of you and your document in your hand, as well as an official photo document / document (identity card, driving license, passport)

Please consider the following requirements for successful account approval:

Do not edit, censor, crop, or scale images.
All the images must be colourful and perfectly visible.
Submitted documents must be a photo (JPG or PNG) or a scanned document (PDF).
All 4 corners of photos and documents should be visible.

Files can be up to 7 MB in size.

To register, you must also provide your bank details, to which we will be able to transfer payments.

You need to choose the right payment option for you to get your future income in the right form.

We may also ask for additional information later, for example, identification or your age.

We may disapprove your account for the following reasons:

Invalid documents
Poor quality images / documents
Invalid document (s)
Mismatched photo (profile photo / cover photo, submitted documents and images)
Profile image and / or cover image is incomprehensible, does not depict you or contains nudity / sexual content
Registering your account would violate our GTC
You are under the age of 18/21

Registrations are processed manually by our staff within 72 hours. Once we have approved your account, you can start earning revenue.

Set your account tracking fee between $ 0 and $ 100.

If you have forgotten your password, click on the ’I forgot my password’ link on the Dizzyfans.com opening and login page. You need to know your email address to use this function.

We recommend that you should manage the account solely, however, if you authorize another person or agency to manage your account, you will always be responsible for your account, and it is not the person or agency that manages the account.

If you provide business information during registration, we also need to request official company documents to make sure that you are a majority owner in the company. You further agree to abide all the laws, including tax laws.

Transaction

Dizzyfans.com is not a party in the transaction, it acts as an intermediary, therefore it does not take responsibility for the authenticity of the transactions.

The rules of the transaction are contained in this document and the Agreement between our content creator and the follower.

A content creator may charge potential followers for tracking his / her account and other private content and services. The price is set in advance by the content creator, which is clearly indicated on the Dizzyfans.com. The price is displayed in USD.

The price shown does not include any taxes such as VAT which our system automatically adds to the amount in a clear way during the transaction. VAT may vary by country.

If the follower has successfully completed the transaction, it is always necessary to make the relevant content available to him / her. If it fails, the content creator will commit a crime of fraud and misrepresentation, embezzlement, and Dizzyfans.com will take immediate action against it in cooperation with the authorities.

You agree to indemnify Dizzyfans.com and the user for any damages, fraud, embezzlement.

Content

You may publish your content in accordance with the rules set forth in this document and our other legal documents. With the following rules, among others:

You own the copyright or authorization to your published content.

You publish and make your content available to your followers. This gives them a viewing right and they can view it for their own legitimate use.

You warrant (you are legally responsible) that:

The content complies with our terms of use and all of our policies and does not constitute a criminal offense.

You own all the copyrights or authorizations / licenses / endorsements over the Content and Account.

You give or can give a valid viewing license to your followers.

You give your followers content of good quality and real as well as relevant and harmonious content with for their subscription and especially and for individual agreements.

You declare that you do not cheat users or on Dizzyfans.com. If you do commit any kind of crime, you accept the consequences.

You agree to be fully and independently responsible for your content and account and reimburse the user and Dizzyfans.com for any damages, material damage, technological damage, virus attacks, crime, fraud, misrepresentation, reputational damages, loss of data and content.

You agree to include your account and content in the Dizzyfans.com database and to manage, modify, restrict, or remove it as a moderator and administrator.

We cannot be held responsible if a user discloses your content, data, or identity.

We cannot take responsibility for the content and manually check each content, but if detected, we will moderate all offensive content and accounts immediately.

Appearance of other person (s) in the content

If you post content on Dizzyfans.com that includes other person (s), the creator of the post assumes full responsibility for the content and declares that:

The other person (s) in the content (image, video) have agreed to post that content on Dizzyfans.com.
The other person (s) in the content (image, video) are content creators on Dizzyfans.com.
The other person consented to the publication of the entry and agreed to it.

The owner of the account who publishes the content is solely responsible for the content.

If the other person (s) in your content are content creators on Dizzyfans.com or potential users, please tag them in the content.

You may not upload content that is not your work or is not authorized to do so, regardless of whether you are featured on it. If the content (photo, video, audio) was not created by you, it is not your property. You shall request for permission to post on Dizzyfans.com.

In each case, the user / account owner who publishes the content is 100% responsible for the content and is entitled to any revenue generated. Any distribution of revenue is the responsibility of the user who publishes the content. In the case of any joint content published with other persons, the persons involved in the content shall enter into and establish a private agreement with each other setting out the terms of cooperation. Dizzyfans.com is not responsible for such disputes. In each case, the parties shall agree among themselves and discuss their differences.

For security reasons, if you post a joint post with other people, please ask the other (s) for written consent.

If suspicious activity occurs in your account or content, our moderators may take restrictive action and sanctions against your account and its content (s). We may even terminate your account if we believe that other people are appearing in the content illegally.

You declare that you accept these rules, that the user who publishes the content is responsible for the content that displays other people, and that you do not make any claims against Dizzyfans.com.

You declare that you enforce all legal and ethical wills against the content creator.

If you have been depicted in any content and would like to appeal removal of such content, please notify us by sending an email here support@dizzyfans.com or click here http://www.dizzyfans.com/contact.

If there should there be a disagreement regarding an appeal, we will allow the disagreement to be resolved by a neutral body.

Payments

Content creators may have most of their revenue (80%). The difference is the remaining fee for the operation of Dizzyfans.com

Dizzyfans.com acts as an intermediary between the payment service provider and the users. The transaction is performed by a third party external payment service provider.

During payments, we collect any tax costs, such as Value Added Tax, with the content creator’s fee. In each case, the sales tax will be transferred to the competent authority, and after deducting the Dizzyfans.com fee, the amount will be transferred to the content creator’s account, to which the bank may charge additional transaction or currency exchange fees.

The content creator’s account shows the creator’s income.

Minimum payout amount: $50

We are committed to truth and justice. Therefore, each user should be aware that if a follower or any other user (even a content creator) submits a refund claim for your content / transaction and we deem it valid, Dizzyfans.com may deduct the refund claim amount from the content creator anytime.

Dizzyfans.com does not store transaction data, it is stored by the payment service provider.

When do we withhold payment?

We reserve the right to impose restrictions on users’ accounts and to reject payment requests in the following cases:

If the content creator has violated our policies (Terms of Service, USC, DMCA, Copyright, Agreement between the content creator and the follower) or is suspected thereof.
If the content creator has committed or is suspected of having committed a crime.
If the content creator does not follow ethical behavior.

Even in the pre-decision period, while the investigation is in progress, Dizzyfans.com may already lock your content creator account for security reasons.

If one or more of the above 3 points become apparent, we will take the appropriate legal and moderating steps that will have consequences for individual user and deprive them of their revenue. In contrast, the user may not have any further claims against Dizzyfans.com. We further oblige the user to settle any damages to Dizzyfans.com and the users involved.

If you have harmed users, Dizzyfans.com will do everything in its power to compensate them.

Taxation

We advise any content creator who has registered for Dizzyfans.com to consult with an accountant or tax advisor in their area of residence to learn the legal basis and legal operation of obtaining income.

The content creators of Dizzyfans.com declare that they operate their account legally and report their incomes to the competent authorities in accordance with the laws of their place of residence. They further declare that they operate their account legally.

Dizzyfans.com is not responsible for users’ individual tax issues / problems or possible non-taxation. However, for all tax proceedings, investigations, lawsuits, penalties, users are requested to inform our customer service at support@dizzyfans.com.

In the event of a violation of tax laws, each creator and user of Dizzyfans.com declare that they will notify Dizzyfans.com employees within 8 days.

Users declare that they will provide Dizzyfans.com staff with full information on the cause, current situation, and foreseeable consequences of the tax case.

We reserve the right to restrict, block, or terminate the content creator’s account if we become aware of a crime, violation of the law, or tax issues.

Policy of Dizzyfans.com – Mandatory

The following policy contains policies and rules for the general use of Dizzyfans.com, which must be followed by each user who use Dizzyfans.com.

Dizzyfans.com may be used by users ONLY for lawful purposes.

Minor users are NOT allowed to register on Dizzyfans.com.

You agree that Dizzfans.com may contains contents for adults.

You may not let your account for rent, sell, or trade it. It may only be used for your own personal purposes.

All the users are required to avoid committing crimes and unethical behavior. In the event of such a detection, you must report the incident to our moderators immediately.

Do not be unethical, hatred, discriminatory, misleading, deceptive, harassing, threatening, violent, do not engage in illegal activity or behaviour.

We are against child pornography. Do not follow or create adult sites and content about anyone under the age of 18/21 because it is a crime. In case of any detection, report it to our moderators immediately.

Don’t cheat or loot anyone.

You may post only real content about you on Dizzyfans.com.

Do not post any (mainly adult) content that includes another person without his / her written consent. You warrant that your co-author is Creator on Dizzyfans, adult (over 18/21) and you verified he/she ID and age.

You may not post content about:

Drugs and drugs trafficking
Firearms, weapons, items that look like weapons and their trafficking
Self-harm, suicide
Shocking, morbid things like death
Animal pornography
Sexual interaction with a family member or close relative
Violence, rape
Health damage and mental injury to others
Torture
Abuse
Capture and being treated as a prisoner
Necrophilia
Disgusting things (urine, faeces, vomiting)
Adult content published in retaliation (pornographic recordings without consent, e.g., against exes)
Prostitution
Human trafficking and trade in organs
Content that constitutes any other criminal offense

You may not upload or, in particular, name unauthorized, unsolicited sexual content that the other party has not consented to.

You may not incite or promote hate speech against racial, ethnic, religious, political, or other groups or individuals. You may not humiliate, attack, threaten, intimidate anyone on the site. We will take immediate action against such cases.

You may not incite hate speech about national or racial identity, caste, gender identity, sexual orientation, age, disability, illness.

You may not post personal information about others on Dizzyfans.com, such as phone number, residence, email address, link to his / her social networking site, official publications, login information to any platform, financial, private and company information, health information.

You may not post adult content if prohibited by law in your country.

You may not post adult content if you have created it in front of public passers-by.

You may not post content if you engage in misleading activity and do not own the copyright or have a power of attorney to do so.

You may not post content that embarrasses others, harms, or annoys others, infringes copyrights, or embarrasses others.

Do not pretend yourself to someone else, organization or person and do not pretend yourself to a Dizzyfans.com employee.

Do not post content that is unfair, infringes privacy or business, or confidential information.

Users may not post content owned by other users or persons, especially without the consent of the other person (s).

Users may not disseminate or reproduce the content of others, neither offline nor online.

Content is the sole responsibility of the content creator and owns or authorizes the use of the content.

You may not use our corporate identity, such as our logos, name, design elements, without our permission.

Provide real personal and banking information.

Do not send unsolicited messages, especially serial messages. (DO NOT SPAM!)

Do not use illegal software.

Do not use software created to increase discredited followers.

Do not post poor quality content.

Do not swear or use obscene words.

Do not try to abide our policies.

Do not post malware, malicious software (such as a virus) on Dizzyfans.com.

The source code for Dizzyfans.com is proprietary. We strictly prohibit its acquisition, copying or discovery of any kind.

You may not compromise the operation, maintenance, and security of Dizzyfans.com.

You may not harm users or us and may not hinder / impede the user’s activity on Dizzyfans.com.

Do not use any automated software or script to access, collect, or damage the servers, network, database, or any other systems of Dizzyfans.com. In this case, we will take immediate legal action against the person.

Violations of these policies may result in the suspension / termination of your account and legal action, depending on the severity of the policy violation (s).

Unacceptable Conduct

The types of conduct described herein are grounds for immediate suspension of service pending investigation by dizzyfans.com and may result in termination of any and all accounts held by the individual, corporation, or website associated with these violations.

1. SPAMMING OR HARASSMENT
The word “Spam” as applied to Email means “Unsolicited Bulk Email”:
“Unsolicited” means that the Recipient has not granted verifiable permission for the message to be sent.

4. VIOLATION OF POLICY

NOTE: Previously accepted “Celebrity sites” must either follow an acceptable “news” format, such as “movie review”, e-magazine, or tabloid formats, or you must have and produce upon our request written documentation of your right to use the material on your website. That documentation must be: (1) a license of the rights; (2) consent from the rights holder or their agent; or (3) a written statement from your attorney explaining your claim to have a lawful right, or a legal defense, to display the material. Dizzyfans and dizzyfans .com partners may at its sole discretion accept or reject your site.

Reproduction or transmission of any material in violation of any local, state, U.S., or international law or regulation is prohibited. Dizzyfans makes every attempt in such cases to work with both U.S. and international law enforcement agencies to provide information about the providers and purchasers of such material. This includes the posting or display of any image or wording instructing users how to make or perform devices or situations that may violate any state, federal, or international law.

Websites must comply with the 18 U.S.C. 2257. Merchants must determine their legal responsibility to and method of complying with 18 U.S.C. 2257 where required to do so.

We will not process orders for websites offering shell accounts. We may cancel any accounts whose primary use can be determined as supporting the use of bots or any other programs executed on a server through a Telnet or a dial-up account.
We will not process for sites advertising or selling the following:

Direct marketing or non-Internet type subscription merchants
Infomercial merchants
Multi-level marketing businesses
Outbound telemarketers
Prepaid phone cards or prepaid phone services
Rebate-based businesses

Pharmaceutical Informational Sites or any site that offer information and/or services in relation to the purchasing of Pharmaceutical drugs
Any website that is in violation of the card associations rules
Credit Protection/Identity Theft Protection
Using a sub-account and its payment form for a site that has been approved to process for another URL that is not registered to that sub-account and approved by a card association.
“Posting in” or any other violation of card associations’ rules.
Violations of card association rules may result in the immediate termination of all services by dizzyfans including recurring billing. Dizzyfans will hold all funds until such time as all card association fines, chargebacks, and refunds have been satisfied.

5. DIZZYFANS RIGHT TO CANCEL
In the event a merchant’s account is suspended for unacceptable conduct or suspicion of fraud, all rebilling members may be cancelled and all monies held for a period of six months to one year. In addition, dizzyfans.com reserves the right, where feasible, to implement technical mechanisms, which prevent the occurrences listed above. Furthermore, dizzyfans is under no obligation to notify its merchant of its actions.

Dizzyfans may deactivate accounts or sub accounts that have not processed any orders within a 90-day period or the payment page is not viewable from the home URL of the website.

6. MONITORING/PRIVACY
Dizzyfans and our payment provider reserves the right, without your permission, to monitor any and all communications through or with its facilities as well as all Merchant sites for compliance with this AUP and our Terms and Conditions.

7. COOPERATION WITH AUTHORITIES
Dizzyfans will cooperate with law enforcement and other authorities in investigating claims of illegal activity including, but not limited to, illegal transfer or availability of copyrighted material, trademarks, child pornography, postings or E-mail containing threats of violence, or other illegal activity.

8. CONFIDENTIALITY OF MERCHANT BUSINESS, PERSONAL AND PERSONAL SUBSCRIBER INFORMATION
Dizzyfans will not release any merchant, affiliate, or customer personal subscriber information, nor merchant or customer billing information, to any third party except upon presentation of a valid court order or request to which dizzyfans.com is legally required to respond to.
